These Terms and Conditions constitute a legally binding agreement (“Agreement”) made between you and ROAM, concerning your access to and use of our website or mobile application (the “Application”). By accessing the Application, you acknowledge that you have read, understood, and agree to be bound by all of these Terms and Conditions. If you do not agree with all of these terms, you are expressly prohibited from using the Application, and you must discontinue use immediately.
Supplemental terms and conditions or documents posted on the Application from time to time also form part of these Terms and Conditions. We reserve the right, in our sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. We may notify you about any changes by updating the “Last updated” date of these Terms and Conditions, and you waive any right to receive specific notice of each such change. It is your responsibility to periodically review these Terms and Conditions to stay informed of updates. Your continued use of the Application after the date of such revised Terms is posted constitutes acceptance of the changes.
The service provided by the Application is not intended for use by any person or entity in any jurisdiction or country where such use would be contrary to law or regulation. Those who choose to access the Application from other locations do so on their own initiative and are solely responsible for compliance with local laws, if applicable.
1 eSIM Service
1.1 ROAM sells prepaid eSIM with data service plans based on eSIM technology (the “Service”). ROAM may resell the Service through a Partner or an Agent.
2 Terms of Service
2.1 Registration
2.1.1 Customers may register for the Service through our website or via other partners or agents.
2.1.2. Customers must provide their First and Last name, and verifiable email address to register. Additionally, customers may voluntarily upload their profile photo and state their travel preferences.
2.1.3. Customers must accept the General Terms and Conditions and the Privacy Policies to register for the Service.
2.2. Purchase and Activation
2.2.1. ROAM may restrict the availability of plans to some countries. Customers can search, select, and purchase our plans on our website or through our partners and agents.
2.2.2. By purchasing the Service, customers acknowledge that they have an unlocked, eSIM-compatible device, a prerequisite for the Service.
2.2.3. On purchase, customers must download the eSIM onto the customer device for the data plans to be configured as per the order. The downloaded eSIM remains on the device after credit depletion or plan expiration. Customers can choose to remove the eSIM in their phone settings at any time.
2.2.4. To implement the Service, customers must download the eSIM and activate the data plan attached to the eSIM, requiring a stable internet connection.
2.3. Duration and Termination
2.3.1. The Service commences immediately following a successful download of eSIM and activation of the associated data plan.
2.3.2. The duration of the Service is as per the terms of the purchased plan.
2.3.3. The Service terminates on full plan consumption or plan expiration, whichever is earlier.
2.3.4. ROAM may suspend the Customer’s use of the Service in case of breach of customer obligations mentioned below, with or without notice. ROAM reserves the right to close the account(s) and request proper payment if the Customer attempts to use ROAM’s credits, promotions, and referrals for the Services (the “Program”) in a questionable manner or breaches any of these Terms & Conditions.
2.4. Engagement
2.4.1. The Service is provided on an “as is” and “as available” basis. ROAM strives to make the Service available at all times, contingent upon network capacity and connection availability. However, network coverage, quality, or availability is not guaranteed.
2.4.2. ROAM partners with other entities to provide the Service. ROAM is not obligated to inform the customer if it uses services from such partners. Customers agree to comply with the Terms and Conditions of our partners as well.
2.4.3. Availability of Service depends on partners’ ability to maintain network capacity and connection availability, with no guarantees.
2.5. Customer Obligations
2.5.1. Customer agrees to use the Service in compliance with these Terms and Conditions and to be responsible for all use of the Service.
2.5.2. Customers agree to submit true, accurate, and complete registration information and to keep such information up to date.
2.5.3. The customer agrees to keep the password confidential and will be responsible for all use of the account and password. ROAM reserves the right to remove, reclaim, or change a username if deemed objectionable.
2.5.4. Customer agrees to use the Service in accordance with all applicable laws and regulations.
2.5.5. Customer agrees that the Service is for personal consumption only.
2.5.6. Customers agree not to engage in any action that is abusive, illegal, or fraudulent or that impairs or damages the Network.
2.5.7. Customer agrees not to misuse credits, promotions, and referrals for the Program, undermining its fairness, integrity, or legitimate operation. ROAM reserves the right to disqualify the customer from the Program and future use of our Services.
2.5.8. Customer agrees that ROAM may suspend the Service in case of breach of the above obligations, and the Customer remains liable for all charges due under these Terms and Conditions for the suspended Services. Deliberate damage or undermining of the Services and the Program may result in legal action.
- Payment Terms 3.1. Customers may register and buy the eSIM on our website: https://clientescadabra.com.br/roambackv3. Payment may be processed through an authorized agent of ROAM.
3.2. All eSIMs are prepaid, and prices are inclusive of any indirect taxes, unless specified otherwise. Indirect Tax will be levied based on the zip code in the billing information related to the Credit Card Payment.
3.3. Indirect Taxes include sales tax, value-added tax, and similar levies imposed by government entities at the time of sale of Plans.
- Returns and Refunds Policy
4.1. Customers will be charged upon the purchase of eSIM.
4.2. Customers may request a refund or a change prior to the installation and activation of the eSIM or in the case of a known technical problem originating from ROAM after activation.
4.3. Complaints or feedback about the Service can be sent to our WhatsApp channel, through our chatbot on our website, to the support team via a message to the Help Center of the mobile app, or email contactus@clientescadabra.com.br.
- Governing Law and Legal Compliance 5.1. This Agreement will be governed by and construed in accordance with the laws of the State of Delaware, USA. Any dispute shall be dealt with in the courts there.
5.2. Other mandatory rules, regulations, and laws of other States or countries may also apply to your use of the Services.
5.3. We may collect personal information from you to comply with legal and regulatory requirements, subject to the terms of our Privacy Policy.
- Intellectual Property Rights Except as otherwise indicated, the Application is our proprietary property. All Content and Marks are owned or controlled by us or licensed to us, protected by copyright, trademark laws, and other intellectual property rights. Content and Marks are provided on the Application “AS IS” for your information and personal use only. No part of the Application and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, displayed, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose without our express prior written permission.
If eligible to use the Application, you are granted a limited license to access and use the Application for personal, non-commercial use. We reserve all rights not expressly granted to you.
Privacy Policy We take customer privacy seriously. Review our Privacy Policy available on the mobile app and website. By using the Application, you agree to our Privacy Policy, incorporated into these Terms and Conditions.
We may disclose your personal details as required by a valid order of an authorized governmental representative or court order. By registering for the Services, you consent to such disclosure, potentially to countries with different data protection standards than the United States.
- ROAM may assign, transfer, or subrogate the rights and obligations arising from this Agreement to any company of its group without the express consent and authorization of the client.
- User Generated Contributions
The Application may invite you to contribute to blogs, message boards, forums, and other functionality. Your Contributions must comply with these Terms and Conditions, representing that you have the necessary licenses, rights, and permissions. We may edit or delete Contributions without notice.
- Contribution License By posting Contributions, you grant us an unrestricted, irrevocable license to host, use, copy, reproduce, disclose, sell, publish, and distribute such Contributions for any purpose. This license applies to any form, media, or technology.
